Sunset clause is scrapped, but environmental regulations still get a hit

The legislation derived from the EU that was retained as part of Brexit will no longer be completely revoked at the end of the year, instead the government has outlined a list of around 600 laws that will be revoked.

REUL’s background

While Brexit took place on 31 January 2020 and UK has already left the EU, in order to provide legal certainty during the transition, the concept of Retained EU Law (“REUL”) was created in the European Union (Withdrawal) Act 2018 (as amended by the EU (Withdrawal Agreement) Act 2020). REUL is a type of domestic law that possesses the features of EU law, which in practice meant freezing the EU law that existed just before Brexit took place.

The original function of the controversial “sunset clause”, included in the Retained EU Law (Reform and Revocation) Bill, was to ensure that all REUL would be revoked by the end of 2023, except for the specific pieces of REUL that were replaced in UK law or expressly preserved. For this purpose, each government department had to identify the REUL that affects its areas and decide what to keep. In simple, all REUL would be revoked except for a selected few.

The sunset clause was heavily criticised because it was unclear exactly what was going to be revoked. More and more REUL were being identified by the government each passing day. For an example, the total number of REUL identified rose from 3,745 in January to 4,829 in May. The work required to identify these REUL was also taking a toll on the government’s resources.

Sunset clause scrapped

Yesterday, the government made a U-turn. The sunset clause was scrapped. Instead, the government has tabled an amendment for the bill’s Lords report stage in a Schedule including a list of around 600 laws proposed to be revoked directly through the REUL Bill (available here). In simple, all REUL would be kept except for the ones in the list.

The reason for this change was provided this way by trade secretary Kemi Badenoch: “with the growing volume of REUL being identified, and the risks of legal uncertainty posed by sunsetting instruments made under EU law, it has become clear that the programme was becoming more about reducing legal risk by preserving EU laws than prioritising meaningful reform”.

In our opinion, this is a welcomed decision from the government. Most of the environmental legislation in the UK derives from EU Legislation, in that regard the uncertainty that the sunset clause was causing was too great and it carried the risk of creating multiple gaps in environmental legislation that would have harmed the UK’s efforts on improving environmental protection.

Despite the above, there is still much to be discussed on the Retained EU Law (Reform and Revocation) Bill. In particular, it still gives the ministers controversial powers allowing them to amend and replace REUL through secondary legislation.
