Many developers will be aware of the need to get bat and other ecology surveys as part of the planning process. The attached article from our planning team discusses a recent prosecution of a developer for failing to comply with the recommendations of such a survey.
All bats are protected by law, under the Conservation of Habitats and Species Regulations 2010. It is an offence to deliberately kill or injure bats or to deliberately disturb them. Importantly, it is also an offence to damage or destroy a bat roost, whether it is done deliberately or by accident.
